WARRANTY AND TERMS OF SERVICE

*Every customer will sign paperwork before project start that includes the following warranty and terms of service. Paperwork will also be signed upon pickup verifying satisfaction of work.*

Definitions:

“Modifications” refer to the customized alterations, additions, or installations performed by Custom Automotive Masters.

“Completion” refers to Custom Automotive Masters’ determination that all required services have been fulfilled, or that a project has been cancelled due to non-payment or other breach of agreement.

Limited 30-Day Warranty on Installation Workmanship:

Custom Automotive Masters warrants that its installation workmanship will be free from defects for a period of thirty (30) days from the day of project pickup. This limited warranty specifically covers the proper and secure installation of parts and components. Examples of covered workmanship include improper wiring connections, loose mounting hardware directly resulting from our installation, or incorrect assembly of components resulting in mechanical issues.

 

The following items are specifically excluded from this Limited Warranty:

- Factory electronics

- Light housings

- Dead batteries

- Lenses

- Factory light bulbs

- Factory suspension components

- Tires

- Factory trim pieces

- Wheels

- Factory drivetrain components

- Any and all powder-coated parts

- Any and all vinyl-wrapped parts​

- The failure of any other parts or components themselves, unless the failure is directly attributed to the installation and workmanship of Custom Automotive Masters within the 30-day warranty period. Part failures (i.e., malfunction, defect, or failure of the product itself) are NOT covered under this warranty and must be addressed with the original part manufacturer under their applicable warranty terms.

The following circumstances are specifically excluded from this Limited Warranty:

- Software issues unrelated to our installation.

- Damage resulting from normal wear and tear, including minor cosmetic blemishes, scratches, or chips (e.g. faded paint, worn tires, dead batteries, chipped/scuffed wheels, etc.).

- Damage caused by external factors such as environmental conditions, road hazards, or improper cleaning.

 

The following circumstances immediately void this Limited Warranty:

- Any use outside of the intended purpose of the part.

- Any modifications, repairs, inspections, or services performed by any individual, shop, or business other than Custom Automotive Masters on any portion of the vehicle after pickup will immediately void the entire 30 Day Limited Warranty, regardless of which specific components were serviced.

 

The customer agrees that:

- They will pay for any and all labor costs for the replacement of failed parts, unless the failure is directly attributed to the installation and workmanship of Custom Automotive Masters within the 30-day warranty period.

- If a workmanship issue arises within 30 days of delivery, Custom Automotive Masters reserves the right, at its sole discretion, to:

           - Repair the issue.

           - Refund the service fee.

Powder Coating and Vinyl Wrap Disclaimer:

Powder coating and vinyl wrap are cosmetic applications. It is NOT covered under the 30-day warranty unless a defect is noted and reported to Custom Automotive Masters prior to payment.

 

If payment is made without documenting any coating issues, all cosmetic concerns thereafter are the sole responsibility of the customer.

 

Customer Inspection and Acceptance:

Upon completion of work, the customer has the right and responsibility to conduct a full inspection of the project at the time of pickup.

- Any concerns must be documented and brought to Custom Automotive Masters prior to departing the premises.

- By accepting the project and leaving the premises, the customer agrees that the work was completed satisfactorily and waives any claims regarding concerns not documented at pickup.

- Custom Automotive Masters will not be liable for any claims regarding normal wear and tear or damage that occurs after the customer takes possession of the project.

Customer Responsibilities:

To qualify for warranty coverage:

- Any defect or issue must be reported in writing within 30 days of receiving the project, including photos or documentation.

- All warranty claims must be submitted via email to: custommastersaz@gmail.com and must include the invoice number, customer name, and a description of the concern.

- All parts and installations must be used and maintained for their intended purposes. Misuse, incorrect re-installation, or modification by any party other than Custom Automotive Masters will immediately void warranty coverage.

- The customer must make the project available for inspection and repair at Custom Automotive Masters’ facility during normal business hours within seven (7) calendar days of notification of defect or issue.

Limitation of Liability:

To the fullest extent permitted by applicable law, Custom Automotive Masters shall not be liable for any incidental, consequential, indirect, special, or punitive damages arising out of or in anyway connected with the modifications, the project, or this agreement, even if Custom Automotive Masters has been advised of the possibility of such damages. The customer acknowledges and agrees that they assume all risk and responsibility for the use and operation of the modified project.

Custom Automotive Masters hereby expressly disclaims all other warranties, express or implied, including but not limited to any warranties of merchantability or fitness for particular purpose, beyond the limited warranty specifically stated herein.

Dispute Resolution:

Any dispute arising out of or relating to this agreement shall first be attempted to resolve through good faith negotiation between parties. If negotiation fails, the parties agree to participate in non-binding mediation in Mesa, Arizona before resorting to litigation. The costs of mediation shall be shared equally by the parties.

​

If mediation does not resolve the dispute within sixty (60) days of the mediation request, the dispute shall be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules, in Mesa, Arizona. Judgment on the arbitration award may be entered in any court having jurisdiction.

Each party shall bear its own attorney’s fees and costs unless the arbitrator rules otherwise.

​

​

Payment Terms:

For projects expected to take longer than one (1) week to complete, the following payment schedule will apply:

- Deposit: A payment covering the full cost of all materials and parts is due no later than three (3) days before the scheduled drop-off date. Failure to make this payment on time will result in the forfeiture of your project appointment.

- Progress Payments: Weekly progress payments equal to 10% of the current remaining balance will be due every seven (7) days after drop-off.

- Final Payment: The remaining balance must be paid in full upon completion of the project and prior to project pickup.

 

Failure to make timely payments according to the agreed-upon schedule will result in the forfeiture of project’s priority in the Custom Automotive Masters’ work queue. In such cases, work on the customer's project will be suspended. Custom Automotive Masters will resume work on the project only after all outstanding payments have been received and after the completion of any other projects that are currently in progress at the time the payment is received. This could result in substantial delays to completion time depending on the scope of the other projects in progress.

Any delays caused by the failure to make timely payments are the sole responsibility of the customer, and Custom Automotive Masters will not be liable for any extended project completion timelines resulting in such payment delays. The customer will also be subject to storage fees as outlined below during this time.

Storage Fees:

If Customer fails to pick up a completed project within seven (7) calendar days after being notified of completion, a storage fee of $65 per week will be applied. The customer is responsible for all accrued storage fees prior to the release of the project.

​

If Customer fails to adhere to the payment terms listed in section seven (7), a storage fee of $65 per week will be applied during the period of delay, effective immediately after a missed payment. The customer is responsible for all accrued storage fees prior to the recommencement of the project.

​

Custom Automotive Masters will take reasonable and prudent care but assumes no liability beyond this standard.

​

 

Severability:

If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions of this Agreement shall remain in full force and effect to the extent permitted by law.

​

The invalid, illegal, or unenforceable provision shall be deemed modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the provision shall be deemed severed from this Agreement, and the remaining provisions shall be construed and enforced as if the severed provision had never been included.

​

Entire Agreement:

This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements and understandings, whether oral or written.

​

​

Governing Law:

This agreement shall be governed by and construed in accordance with the laws of the State of Arizona.
